Road accident leads to compensation

A man has been compensated with tens of thousands of pounds after he was injured in a car accident

The man, who was in his late twenties at the time of the accident, was based in North London.  He was a passenger in a security case collection vehicle, as it was being driven by a colleague.  As the vehicle came to a roundabout, the driver lost control and the vehicle turned onto its side.

The man himself spoke about the car accident and explained what happened, saying: "As the van overturned, my left shoulder and back were injured.

He also mentioned the effects that the accident had on him getting back to work.  The man said: “After the accident, I was able to use my left arm for light work but couldn’t undertake any significant lifting, heavy housework or heavy gardening.  My back injury improved but the nerve in my left shoulder was trapped and it caused me constant pain.”

Following the accident and the hospital treatment that the man received, he was forced to take time off from work.  He then tried to get back to work and initially took up light duties.  This however did not last for a long period of time.

Loss of earnings after accident

The man then applied for internal positions, one of which was a surveillance driver, but his employers felt that his condition following the car accident, would make him a health and safety risk if he took up the job role.

Following this, the man was placed on a three month retention programme, but this was extended as it was not completed effectively and his job was eventually terminated.

Paul Campbell, the organiser of the GMB trade union, said: "As a result of the accident, our member sustained such serious injuries that he has lost his job and suffered a significant loss of earnings.”

Mr Campbell also stated that the union were very thankful and happy with the outcome of the court case and commended all the success, help and the professionalism that they were given by the no win no fee personal injury lawyer’s firm.

The man decided to seek compensation for the car accident that eventually led to the loss of his job.  He contacted the no win no fee personal injury lawyer’s firm, which went on to represent him with his case.  He was successful and received a compensation of more than £32,000.

No work found after accident

Samantha Brown a spokesperson from the no win no fee personal injury lawyers firm, which represented the man said: "Despite our client’s efforts to return to work, his employer did not find suitable employment for him that would have accommodated his physical restrictions.”

She mentioned the range of alternative job roles that the man attempted to take up in his return to work.  Sarah said: “When his employment was terminated, he sought numerous jobs such as roles as a valeter, a mobile customer service adviser, a store operative and, a data entry position.”

She further explained the extent that the man endured to get back into work, including taking up new courses, adding that the compensation the man received would go towards compensating him for the lost funds.

She said: “He even underwent retraining at his own cost in an effort to get back to work, despite his painful injury.  The compensation is therefore welcome and wholly justified.”
